I. Identity and Address of the Personal Data Controller.
WARE MALCOMB, S. DE R.L. DE C.V. (hereinafter the “Company”), with its domicile on Culiacán #123, Código 2, Hipódromo, Cuauhtémoc, CP 06170, en la Ciudad de México, CDMX, will be considered as the Controller of the Personal Data, according to the Federal Law on the Protection of Personal Data Held by Private Individuals (the “Law”) and its bylaws, notify you the following:
All capitalized terms not otherwise defined herein shall have the meaning ascribed to in the Law.
II. Purposes for collecting your Personal Data.
Main Purposes. (i) To comply with the various legal regulations in force and applicable in Mexico, (ii) human resources management relating to the employment relationship that may be maintained with the Data Controller if selected as a candidate and employee, (iii) to protect and defend the rights and interests of any company belonging to the COMPANY (including in relation to any administrative, judicial, arbitration, or mediation proceedings), (iv) Respond to legal proceedings, (v) to carry out educational and employment background checks applicable to the company’s hiring process.
III. Personal Data collected.
Derived from the relationship stablished or about to be established with the Company, it is necessary that the Company collects, manages and administrates the following personal data: NAME, PLACE, DATE OF BIRTH, NATIONALITY, AGE, SEX, MARITAL STATUS, FAMILY NAMES AND ECONOMICS DEPENDENTS, PERSONAL DOMICILE, FEDERAL TAXPAYER REGISTER, UNIQUE POPULATION REGISTRY KEY (CURP IN SPANISH), ACADEMIC INFORMATION AND PROFESSIONAL REFERENCES, SOCIAL SECURITY IDENTIFICATION DATA, PREVIOUS EXISTENCE OF WORK RELATED ACCIDENTS OR DISEASES, DEDUCTIONS FOR IDENTIFICATION OF ALIMONY, LABOR RECORDS, LOANS WITH THE INSTITUTE OF THE NATIONAL HOUSING FUND FOR WORKERS (INFONAVIT) OR WITH THE NATIONAL WORKERS’ WELFARE FUND INSTITUTE (INFONACOT), among others.
IV. Sensitive Data collected.
Additionally, it is necessary that the Company gathers, manages and administrates the following data, categorized as “sensitive” data by the Law, in order to confront any illnesses prevention: EXISTENCE OF ANY SERIOUS DECEASE, EXISTENCE OF NON-TRANSMISSIBLE CHRONICAL ILLNESSES (arterial hypertension, renal insufficiency, lupus, cancer, diabetes mellitus, obesity, liver failure or metabolic disorder, cardiac diseases), EXISTENCE OF ANY CONDITION OR PHARMACEUTICAL TREATMENT THAT GENERATES SUPPRESSION TO THE IMMUNOLOGIC SYSTEM.
V. Sources of Personal Data.
For the purposes stated on the present privacy policy, the personal data can be obtained through the following ways:
(i). Directly provided; the data is provided personally by the Data Subject thought diverse sources.
(ii). Indirectly obtained by:
a. Electronic Media: In case the information is provided through an Internet Site, or any other online service; or
b. Any other source permitted by the applicable Law; telephone books or labor directory and others.
VI. Personal Data Transfers.
The Personal Data provided can be transferred to any of the affiliated companies of the Company, by its holdings or subsidiaries, either foreign national or third parties, only upon request of an authority, for medical diagnosis, for hiring services at their benefit once hired as an employee of the Company, curricular purposes of employee’s evaluation by prospective customers or prospective clients or clients of the Company; or for compliance derived from a legal relationship between the personal data subject and any other company of the Company.
Further, the Company could transfer your personal data to third parties for them to conduct educational and work-related background checks, as part of the selection and hire process applicable in the Company. VII. Right to Access, Rectification, Cancelation and Opposition (ARCO), Consent Revocation and Limit to the use or disclosure of your Personal Data.
As a data subject, you have the right to; access, rectify, update, cancel or/and object the collection of your Personal and Sensitive Data, as well as to object the processing thereof, or revoke the consent granted for such purpose, through the procedure implemented. Also you can contact directly at the corresponding Human Resources area or by post to the address located on the domicile indicated in this notice, addressed to “Personal Data Assistance”, including name, domicile, identification document, indicating the data that you intend to access, rectify, cancel or object to treatment.

I. Identidad y Domicilio del Responsable de los Datos Personales.
WARE MALCOMB, S. DE R.L. DE C.V. (en adelante la “EMPRESA”) con domicilio ubicado en: Culiacán #123, Código 2, Hipódromo, Cuauhtémoc, CP 06170, en la Ciudad de México, CDMX., será considerado el Responsable de los Datos Personales, de conformidad con las disposiciones de la Ley Federal de Protección de Datos Personales en Posesión de Particulares (la “Ley”) y su Reglamento.
Todos los términos en mayúsculas que no estén definidos en el presente documento tendrán el significado atribuido a dicho término en la Ley.
II. Finalidades para las que se recaban los Datos Personales.
Finalidades Principales. (i) Dar cumplimiento a los distintos ordenamientos legales vigentes y aplicables en México, (ii) administración de recursos humanos relativa a la relación laboral que se podrá sostener con el Responsable en caso de ser seleccionado como candidato y empleado, (iii) Proteger y defender los derechos e intereses de cualquier empresa de la EMPRESA (incluso en relación con cualquier procedimiento administrativo, judicial, arbitral o de mediación), (iv) Responder a procesos judiciales, (v) para realizar comprobaciones de antecedentes educativos y laborales aplicables al proceso de contratación en la empresa.
III. Datos Personales recabados.
Derivado de la relación que usted ha establecido o está por establecer con la Empresa, es necesario que la Empresa, recabe, maneje y administre los siguientes datos personales: NOMBRE, LUGAR Y FECHA DE NACIMIENTO, NACIONALIDAD, EDAD, SEXO, ESTADO CIVIL, NOMBRE DE FAMILIARES Y DEPENDIENTES ECONÓMICOS, DOMICILIO PARTICULAR, CLAVE DEL REGISTRO FEDERAL DE CONTRIBUYENTES, CLAVE ÚNICA DE REGISTRO POBLACIONAL, DATOS ACADÉMICOS Y REFERENCIAS PROFESIONALES, DATOS DE IDENTIFICACIÓN DE SEGURIDAD SOCIAL, EXISTENCIA DE ACCIDENTES Y/O ENFERMEDADES DE TRABAJO PREVIAS, IDENTIFICACIÓN DE RETENCIONES POR PENSIÓN ALIMENTICIA, ANTECEDENTES DE CARÁCTER LABORAL, CRÉDITOS CON EL INSTITUTO DEL FONDO NACIONAL DE LA VIVIENDA PARA LOS TRABAJADORES (INFONAVIT) O CON EL INSTITUTO DEL FONDO NACIONAL PARA EL CONSUMO DE LOS TRABAJADORES (INFONACOT), entre otros.
IV. Datos Sensibles recabados.
Adicionalmente, es necesario que la Empresa recabe, maneje y administre los siguientes datos, categorizados por la Ley como “sensibles”, a efecto de hacer frente a cualquier prevención de enfermedades: EXISTENCIA DE ENFERMEDADES GRAVES, EXISTENCIA DE ENFERMEDADES CRÓNICAS NO TRANSMISIBLES (hipertensión arterial, pulmonar, insuficiencia renal, lupus, cáncer, diabetes mellitus, obesidad, insuficiencia hepática o metabólica, enfermedades cardiacas), EXISTENCIA DE ALGÚN PADECIMIENTO O TRATAMIENTO FARMACOLÓGICO QUE GENERE SUPRESIÓN DEL SISTEMA INMUNOLÓGICO.
V. Fuentes de datos personales.
Para las finalidades señaladas en el presente aviso de privacidad, los datos personales pueden ser obtenidos a través de distintas formas:
(i) Directamente proporcionados: los datos son personalmente proporcionados por el Titular a través de diversos medios.
(ii) Indirectamente obtenidos por:
a. Medios Electrónicos. En el caso de que sean proporcionados a través de un sitio de Internet, o cualquier otro servicio en línea; o
b. Otras fuentes permitidas por la Ley aplicable; directorios telefónicos o laborales, entre otros.
VI. Transferencia de Datos Personales.
Los datos personales proporcionados pueden ser transferidos a cualquiera de las empresas de la Empresa, por sus matrices o subsidiarias o bien a terceros nacionales o extranjeros, únicamente por requerimiento de una autoridad, para diagnóstico médico, para la contratación de prestaciones en su beneficio una vez contratado como empleado de la Empresa, fines de evaluación curricular del empleado por parte de candidatos prospectivos o clientes de la Empresa, o para el cumplimiento de obligaciones derivadas de una relación jurídica entre el titular de los datos personales y cualquiera de las empresas de la Empresa.
Además, la Empresa podría transferir sus datos personales a terceros para que estos realicen comprobaciones de antecedentes educativos y laborales, como parte del proceso de selección y contratación aplicable en la Empresa. Dicha transferencia se realizará de conformidad con la Ley. Seleccione si da su consentimiento o no a esta transferencia.

VII. Derecho de Acceso, Rectificación, Cancelación, Oposición (ARCO), Revocación del Consentimiento y Limitación al Uso o Divulgación de sus Datos Personales.
Como titular, usted tiene derecho de acceder, rectificar, actualizar, cancelar y/u oponerse a que sus Datos Personales y Sensibles se recaben, así como para oponerse al tratamiento de los mismos, o bien, revocar el consentimiento que para tal fin se haya otorgado, a través del procedimiento implementado. Para conocer dicho procedimiento, puede ponerse en contacto con el área responsable del manejo y administración de datos personales, a las direcciones de correo electrónico: careers@waremalcomb.com.
Así mismo también se puede contactar directamente al área de Recursos Humanos que corresponda; o bien, por correo postal, al domicilio de la Empresa, mismo que se encuentra determinado al inicio del presente, dirigido a “Atención a Datos Personales”, incluyendo su nombre, domicilio, documento de identificación, señalando los datos que se pretendan acceder, rectificar, cancelar u oponerse a tratamiento.
VIII. Modificaciones, cambios o actualizaciones.
